Please read these Terms of Service ("Terms") carefully before using our website or placing an order. By accessing zyave.com or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our website.

2. Eligibility

By using this website, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872, and not barred from receiving services under applicable Indian law. Users under 18 may browse only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf. Purchases on behalf of a minor must be made and authorized by their parent or legal guardian.

3. Account Registration

Account creation is optional — guest checkout is available on zyave.com. If you create an account, you are responsible for maintaining the confidentiality of your credentials and all activities under your account. You agree to provide accurate information. ZYAVE reserves the right to suspend or terminate accounts that violate these Terms.

4. Products & Pricing

All product descriptions and images are provided in good faith. Prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise. ZYAVE reserves the right to modify prices without prior notice. In case of a pricing error, ZYAVE may cancel the order and issue a full refund. Product colors may vary slightly due to screen settings — this does not constitute a defect. Size charts are a guide; fit may vary by body type.

5. Orders & Payment

Placing an order is an offer to purchase — it is not confirmed until you receive an Order Confirmation email. ZYAVE may refuse or cancel any order at its discretion. Accepted payment methods include UPI, credit/debit cards, net banking, wallets, and COD where available. All online payments are processed through secure, PCI-DSS compliant gateways. ZYAVE does not store your card details.

6. Order Cancellation

Orders may be cancelled by the customer only before they are dispatched. To cancel an order, contact us immediately at officialzyave@gmail.com or +91 9229881184 with your Order ID. Once an order has been shipped, cancellation is not possible — a return or refund request may be raised after delivery as per our Return & Refund Policy. There are no cancellation charges for orders cancelled before dispatch. For prepaid orders cancelled before dispatch, a full refund will be processed to the original payment method within 5–7 business days. For COD orders cancelled before dispatch, no refund is applicable as no advance payment is collected. ZYAVE reserves the right to cancel any order at its discretion due to stock unavailability, pricing errors, or suspected fraud, with a full refund issued to prepaid customers where applicable.

7. Shipping & Delivery

ZYAVE currently ships within India only. Orders are typically processed within 1–2 business days. Delivery timelines are indicative and may vary due to courier delays, public holidays, or circumstances beyond our control. ZYAVE is not liable for courier delays once the order is dispatched. Risk of loss passes upon delivery, except for claims under our Return & Refund Policy for damaged, defective, or incorrect items. 8. Returns, Exchanges & Refunds

All return, exchange, and refund requests are governed by our Return & Refund Policy at zyave.com/policies/refunds, which is incorporated into these Terms by reference and forms an integral part of these Terms. Please review it carefully before placing an order.

9. Intellectual Property

All content on zyave.com — logos, brand name, images, text, graphics, and videos — is the exclusive property of Zyave Athleisure Private Limited, protected under Indian intellectual property laws. You may not use any content for commercial purposes without prior written consent. Unauthorized use may result in legal action.

10. User Conduct

By using our website, you agree not to use the site for unlawful purposes, submit false or defamatory content, attempt unauthorized access to our systems, use bots or scrapers to extract data, or engage in conduct that disrupts the website. ZYAVE reserves the right to block users who violate these conditions.

11. User-Generated Content

If you submit reviews, photos, or other content, you grant ZYAVE a non-exclusive, royalty-free license to use and display such content for marketing purposes, for as long as necessary or until you request removal. You may request removal at any time by emailing officialzyave@gmail.com, in line with your rights under the Digital Personal Data Protection Act, 2023. ZYAVE may remove any content deemed inappropriate.

12. Third-Party Links & Services

Our website may contain links to third-party websites. ZYAVE is not responsible for their content, privacy practices, or terms. Accessing such links is at your own risk.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zyave Athleisure Private Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of the website, your violation of these Terms, your violation of any third-party rights, or any content you submit on the website.

14. Disclaimer of Warranties

Our website and products are provided on an "as is" and "as available" basis. ZYAVE makes no warranties regarding accuracy or completeness of content, and does not warrant uninterrupted or error-free service. This disclaimer does not affect your statutory rights under the Consumer Protection Act, 2019, including your right to defect-free products.

15. Limitation of Liability

ZYAVE's total liability for any claim shall not exceed the amount paid by you for the specific order. ZYAVE is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability where such limitation is not permitted under the Consumer Protection Act, 2019 or other applicable Indian law.

16. Force Majeure

ZYAVE is not liable for failure or delay due to circumstances beyond its control, including natural disasters, pandemics, government actions, strikes, or courier/payment disruptions.

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

18. Waiver

Failure by ZYAVE to enforce any provision of these Terms at any time shall not be construed as a waiver of that provision or of the right to enforce it subsequently. No waiver of any breach shall be deemed a waiver of any subsequent breach.

19. Assignment

ZYAVE may assign or transfer these Terms, in whole or in part, to any successor entity in connection with a merger, acquisition, restructuring, or sale of assets, without prior notice to you. You may not assign or transfer your rights or obligations under these Terms without ZYAVE's prior written consent.

20. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Zyave Athleisure Private Limited with respect to your use of zyave.com, and supersede all prior agreements, representations, or understandings.

21. Privacy

Your use of zyave.com is governed by our Privacy Policy at zyave.com/policies/privacy, incorporated into these Terms by reference.

22. Modifications to Terms

ZYAVE may update these Terms at any time. Changes are effective immediately upon posting. Continued use of the website constitutes acceptance of the revised Terms.

24. Governing Law & Jurisdiction

These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts at Ranchi, Jharkhand.
